Family members tell News 13, the victim of a hit and run incident in Fletcher's Hooper Creek area, has died.

Brian Capps died Wednesday from his injuries from the August 3rd incident.

Thursday Henderson County District Attorney Greg Newman said that following Capps' death, he reexamined the facts in the case with the investigating officers and determined that the original felony hit and run charge against the suspect will stand.

Michael Waycaster, 40, of Gastonia was arrested on that charge three days after the accident.

Newman said he considered changing the charge to involuntary manslaughter, but decided against it, saying it would not be an upgrade and sentencing for each would about the same.

Authorities say Capps has been walking on Southern Road when he was struck by Waycaster. Waycaster then fled the scene.
