Prosecutor Comments On Guthrie Charges

Updated: Friday, August 2 2013, 09:22 PM EDT

First-degree murder charges may not stick because of a decades old change in the law.

Kenneth Guthrie was convicted of assault with intent to kill in 1991. He's now charged with Jackie Maybin's murder. Maybin died in December of 2012. The medical examiner ruled her death a homicide connected to the original assault.

In recent years, new murder charges can be filed in cases where a victims dies from injuries if the death can be tied to the original crime. However, that wasn't the law around the time Maybin was severely injured by Guthrie.
