Sewage Lawsuit

The owners of a real estate business in Andrews are suing the town after their offices flooded with raw sewage.


Town leaders have no comment while the case is under way. But business owners, Kandy and Ricky Barnard want $10,000 from the town for damages to their Valleytown Realty business on Main Street.

They also want the town to repair the sewer line that caused the problem. They say the town ignored their notices about the defect in the sewer line for at least two years and during heavy rain in January raw sewage gushed into their offices.


The Barnards' lawsuit claims raw sewage surged into their building "spraying up like a fountain."  They’ve had to relocate as the building remains contaminated. Samples were taken to the Cherokee County Health Department which confirmed the presence of coliform and e-coli bacteria. The lawsuit also claims Kandy Barnard's health has been compromised by breathing in contaminants.
