Handicapped Man Arrested For Rape
A mentally handicapped woman in Henderson County says she was raped.
Hendersonville Police have arrested 28-year-old Calvin Levi in the case, who's also mentally handicapped. He's been arrested and charged with second degree rape and three counts of second degree sexual offenses.
On Tuesday, Calvin's family says he grew up with the alleged victim, has no history of aggressive behavior and doesn't believe he ever would have committed a violent crime.
The Levis say Hendersonville Police have not contacted the family to confirm he is legally considered to be mentally impaired, and are concerned his disability is not being taken into account in the investigation.
Police said Tuesday they do not take mental disabilities into account when working a case, but rather evaluate whether a person is able to determine right from wrong when considering bringing charges.
Police are not releasing details in the case citing the nature of the alleged crimes, so News 13 was not able to reach the victim or her family Tuesday.
