The Highway Patrol is investigating a car accident involving an Asheville police officer. It happened at 9:30 Monday night near the Shell Gas Station near the I-40 exit at 215 Hendersonville Road, near Biltmore Village.

The Highway Patrol said the officer involved, Sergeant Michael McClanahan was responding to a non-emergency call and did not have his lights on. An SUV, driven by Stuart Ghertner, from Nevada, crashed into the cruiser while trying to merge on Hendersonville Road.

McClanahan was treated and released for minor injuries. Ghertner was not hurt.
Troopers say they will consult with the district attorney's office wednesday to see if charges will be filed.
