UPDATE: Nightclub Shooting Suspect Arrested
The man police say opened fire into a crowd outside of a Marion nightclub early Saturday morning has been taken into custody.
Earl Spencer Boyce, 35, of Forest City, was arrested in Rutherford County around 4 p.m. Monday. He is charged with three counts of assault with a deadly weapon, one count of assault with a deadly weapon with intent to kill and one count of possession of a firearm by a felon.
Four were taken to the hospital after, Marion Police say, Boyce pulled out a gun in the parking lot of Vortex Nightclub and fired several shots aiming low to the ground.
One man was shot in the leg, one woman was grazed on the leg and the foot and a third was burned by a shell casing.
Boyce then fled the scene with several other people. Marion Police Department squad cars were used to shuttle the injured to ambulances waiting down the road because the scene had not been secured, with dozens of people still standing in the parking lot and the suspect not apprehended.
Police say a fight began inside of the club and spilled into the parking lot.
Vortex owner Jake Asta says a "dance-floor scuffle" that began inside was not connected with the shooting in the parking lot. Asta said he did not recognize Boyce as a party attendee.
Asta released a statement Monday:
"Our hearts and prayers go out to those injured Friday evening. A family event turned tragic as individuals outside the club were targeted by a
man with a gun. We've been here 8 years and never seen this type of violence before. We understand an investigation is underway and hope
the person responsible is brought to justice."
The party inside of the club was billed on Facebook as a birthday event, police say more than 100 people attended, many of them family members.
Police say Boyce was not a member of the family.
