Double Homicide Investigation

A man accused of killing his next door neighbors had his first court appearance on first degree murder charges this morning.

Police say Erwin Jarvis shot Genise Mathison and Robert Matheson III at their home on Birch Lane yesterday afternoon.  The victim's 12-year-old son was not injured in the incident, he is in DSS custody at this time.

This morning, the judge told Jarvis he faces a sentence of death or life in prison if he is convicted on the first degree murder charges.  Jarvis asked for a court appointed attorney, and the judge agreed.

Jarvis is being held in the Buncombe County jail without bond.  That is common in first-degree murder cases.

Police responded to Birch Lane yesterday after neighbors called for help after hearing gunfire near the Matheson's home.  Police say multiple shots were fired.

Neighbors took photos yesterday afternoon as Asheville police held Jarvis on the ground and arrested him.  Neighbors told us that Jarvis and the Mathesons had an ongoing dispute, and that the Mathesons had put up an orange fence because of those arguments.

Jarvis' next court appearance is set for October 22nd.
